Alfonso Castañeda, Nueva Viscaya Mayor Jerry Pasigian has appealed before the Sandiganbayan 5th Division his conviction over the anomalous purchase of a sports utility vehicle (SUV) worth P1.35 million in 2009.
“The prosecution, as mentioned earlier, failed to present proof as to the value of vehicles of the same make, model, year and specifications during the time that the subject purchase was made,” read his motion for reconsideration.
“There is thus no basis of comparison and the statement that ‘bidders who may have offered on equivalent item at terms more advantageous to the municipality’ is a mere speculation and conjecture, which would not amount to proof beyond reasonable doubt,” he argued.
The anti-graft court has issued a decision which found him guilty of graft and malversation.
With this, Pasigan was sentenced to imprisonment of six years and one month up to 15 years for graft and another four years and five months up to seven years and four months for malversation.
The case stemmed from the purchase of a a 2003 Nissan Patrol which was found overpriced and did not undergo the required public bidding when it was bought from Gilbert Arellano.
The vehicle was even registered under his name and was never returned to the government.
