Gamu, Isabela Mayor Nestor Malasig Uy has been convicted for disapproving in 2013 the appointment of staff of councilors.
The Sandiganbayan 3rd Division has issued a decision which found Uy guilty of usurpation and, with this, sentenced him to imprisonment ranging from two months and one day up to six months and one day.
The case concerns his 2013 disapproval of the appointment papers of legislative aide Dante Martinez, clerk Jasmin Rose Martinez, and drivers Silverio Balagan and Michael Balagan.
The Office of the Ombudsman which filed the case pointed out only the vce mayor had the authority to approve the appointments.
The anti-graft court pointed out Uy should have just returned their appointment papers “unacted and stated the reasons therefor.”
“The failure of the accused to do so only reinforces the conclusion that he tacitly disapproved the subject appointments which he had no power to do,” it ruled.
