Ilocos Sur town wins 1,100-hectare land in dispute vs Bakun, Benguet

The municipality of Sugpon, in Ilocos Sur has won a land dispute case against the municipality of Bakun in Benguet.

According to the details of the dispute, the two municipalities are fighting over the jurisdiction of over a 1,117.20-hectare land located within their boundaries.

The Supreme Court denied for lack of merit the petition of the municipality of Bakun’s through a decision released by Justice Mario Lopez of court’s Third Division. The Bakun town assailed the decision dated February 1, 2018 and the resolution dated July 6, 2018 of the Court of Appeals which in turn affirmed as a whole the resolutions of the local court in Ilocos Sur.

SC has sided with the RTC which are supported by the evidence on record including the administrative map of Benguet showing that the disputed area was beyond its territorial area, noting that Bakun “simply failed to show, by preponderant evidence, that the conflicted areas are located within the new boundary line.”
