Court denies petitioners’ plea to stop Mayor Salda’s order protecting Puguis communal forest

A local court has junked a petitioners request to stop the implementation of La Trinidad Mayor Romeo Salda’s memorandum barring further encroachments within the Puguis communal forest.

The petitioners earlier questioned the validity Benguet politiko’s order to the local government to prevent ongoing construction inside the Puguis communal forest.

Judge Danilo Camacho, in his decision, said the ownership claim of Evaristo Tiotioen, was unfounded and without basis.

He also quoted a Court of Appeals decision that Tiotioen and his heirs have been in “open, continuous, exclusive, and notorious possession and occupation of the properties in the concept of owner since June 12, 1945 or earlier.”

The local court also said the CA ruling was clear in its decision that the lots were not alienable and disposable.
