Tuao, Cagayan Mayor Francisco Mamba Jr. has asked the Sandiganbayan 5th Division to quash the graft charges against him over his alleged involvement in the fertilizer fund scam.
Mamba pointed out in his motion to quash that the Office of the Ombudsman violated his constitutional right for the speedy disposition of cases since it took around 14 years before charges were filed before the Sandiganbayan.
“No explanation has been offered by the Special Task Force in its resolution for the unreasonable delay,” read his motion.
The case concerns the 2004 purchases of fertilizers from Feshan Philippines worth P1,500 per bottle.
The town purchased a total of 3,333 bottles of fetilizers worth P4.95 million.
The Ombudsman cited irregularities in the purchases including the absence of public bidding and the failure to monitor the proper utilization of the funds.
